✅ How It Works – 4 Simple Steps

Step 1: Attorney-Prepared Documents

Complete our secure online questionnaire. A licensed Texas attorney reviews your answers and drafts all required divorce documents, customized for your situation and compliant with your county’s District Court.

Step 2: Legal Compliance

Attorney prepared divorce documents are delivered for both spouses to review for legal compliance and accuracy. Your spouse has 7 days to review. If they do not, you can proceed with online document execution or extend the review period by 7 more days. Next, you pay the $176 Online Processing Fee for online document execution and e-filing of the Petition. After payment, you will sign the Original Petition for Divorce.

Step 3: Filing the Petition

Pay the Court Filing Fee Deposit ($400). Texas court filing fees vary by county and may also vary depending on whether the case involves children. Because the exact court amount is not confirmed until we file, we collect a $400 deposit toward the total filing fees so we can move forward with the court filing. The actual amount paid to the court may be less than or more than $400, but $400 is the common average and this is why we collect this amount. Multiple receipts will be sent to you directly from the court with the exact fees. Before the case is finalized with the court, you will receive a final invoice showing: the exact court fees paid and any remaining balance due or any overpayment credit plus the final filing fee. We will then file your signed Original Petition for Divorce and the Clerk of the Court will issue a Cause and a Court Number. We will then update the rest of the documents and any other requirements for the filing County and present the documents to your spouse to sign and notarize.

Step 4: Online Notarization and Final Filing

Now that your spouse has signed and notarized the documents they are done with the process. You must now sign and notarize the documents and we will file them all with the court. The Final Fee is $196.00 to cover the costs of remote online notary and our e-filing service fees. You previously paid a $400 Court Fee Deposit. Since Texas filing fees vary by county and case specifics, we will reconcile your deposit with the actual court fees at this time and adjust that amount against the $196 final fee.

Court Filing Fee

Texas courts charge a mandatory filing fee, which varies by county but typically ranges from $350 for cases without children to $401 for cases with children. This is paid directly to the District Clerk's Office in your county when your Petition for Divorce is filed.

  • If you select the Fully Guided Service, we’ll assist in calculating and collecting the correct filing fee and submit it when we e-file your case.
  • If you’re using the Standard Service, we’ll provide detailed instructions for paying the court directly when you file in person or by mail.

If you’re facing financial hardship, you may be eligible to request a court fee waiver by submitting an Affidavit of Inability to Pay. We provide the required forms and can help you determine eligibility.

🏛️ Texas Residency Requirements

To file for divorce in Texas, at least one spouse must meet the state's residency requirement.

Under Texas law (Texas Family Code § 6.301):

  • You or your spouse must have lived in Texas for at least 6 months, and
  • In the county where you plan to file, at least 90 days.

Acceptable proof of residency may include:

  • A valid Texas driver’s license or state-issued ID
  • Utility bill or lease agreement showing current Texas address
